The law
The federal Fair Housing Act prohibits discrimination in the sale, rental, and financing of housing based on race, color, religion, sex, national origin, familial status, and disability. The Florida Fair Housing Act (Chapter 760, Florida Statutes) provides the same protections statewide. Miami-Dade County and Broward County ordinances add further protections, including sexual orientation, gender identity, marital status, age, and other classes as defined by each county.
As a licensed Florida real estate agent and a member of the National Association of Realtors, I am also bound by Article 10 of the Realtor Code of Ethics, which prohibits discrimination in providing services and in employment practices.
What this means in practice
- I show and market properties to everyone who qualifies, without steering anyone toward or away from any neighborhood.
- I present all offers and treat every buyer, seller, and tenant the same.
- I do not make, print, or publish advertising that indicates any preference, limitation, or discrimination.
- I provide reasonable accommodations for people with disabilities, including alternative ways to view properties and communicate.
- I follow these principles in probate, divorce, and estate transactions just as in any other sale.
Reporting discrimination
If you believe you have experienced housing discrimination, you can file a complaint with the U.S. Department of Housing and Urban Development at hud.gov/fairhousing or by calling 1-800-669-9777 (TTY 1-800-877-8339). In Florida, you can also contact the Florida Commission on Human Relations at fchr.myflorida.com or 1-850-488-7082.
